The complainant company was founded in the year 1997 as Google Search Engine and is now the most highly recognized and widely used internet search services in the world. The complainant uses the trademark GMAIL in USA since 1998. GMAIL is also the complainant’s award winning web-based email service. The trademark GMAIL has been registered in India and many other countries. The domain gmail.com has been held by the complainant since 1995. The respondent registered the disputed domain name in 2013 and the website is virtually identical to the Sign In page of the complainant’s GMAIL service. The respondent stated that he registered the website to help users learn about GMAIL.
Findings & Award:
Disputed domain name identical and confusingly similar to trademark of complainant;
Respondent has no rights or legitimate interest;
Respondent registered the disputed domain name in bad faith. It was ordered that the disputed domain name be transferred in favor of the complainant.
