The complainant is the proprietor of the registered trademark “saavn” and has been using the mark ever since 2007. Respondent registered the domain name saavn.in incorporating the mark of the complainant and hence the case. On receiving the notice from the arbitrator respondent agreed to settle and conveyed his intention to transfer the disputed domain name

Findings & Award:

Disputed domain name identical and confusingly similar;

Has no rights or legitimate interest registered in bad faith;

Ordered that the domain name be transferred.
