Facts of the case:
The complainantadopted the term Amazon.com in the year 1994 and started its virtual activities through the said portal in 1995. They have also registered the trademark AMAZON in India and other 125 countries and also registered the domain amazon.co.in and amazon.in in India in 2003 and 2005 respectively. The disputed domain name was registered by the respondent illegally and without authority.
Findings & Award:
Disputed domain name identical and confusingly similar to trademark of complainant;
Respondent has no rights or legitimate interest;
Respondent registered the disputed domain name in bad faith;
It was ordered that the respondent shall transfer the disputed domain name in favour of the complainant.
