Complainant is the proprietor of the mark “nutrilite” and has been ranked 39 by Forbes as one of the largest private companies in the United States in 2009. The mark is being used by the Complainant worldwide and also in India, United States and the United Kingdom in relation to its business. The mark has been highly publicized and advertised by the Complainant in both the electronic and print media both in India and globally. Respondent registered the domain nutriliteindia.co.in in 2010 incorporating the Complinant’s mark.

Findings & Award:

Disputed domain name identical and confusingly similar;

Has no rights or legitimate interest registered in bad faith;

Ordered that the domain name be transferred to the complainant with a request to NIXI to monitor the transfer.
