Facts of the case:

The Complainant is a company existing and incorporated under the laws of Canada, since inception in 1995. They are engaged in the business of providing effective active nutrition products, namely two types nutritional supplements and weight management properties. These products are sold in more than 133 countries around the world. Among these is the most prominent brand of nutritional supplements, that is, MUSCLETECH. These were introduced 20 years ago and has used it since then. Furthermore, they have registered the domain name muscletech.com in the year 1997 along with several other domain names with the word ‘muscletech’, with registrations in India as well.

The Complainant came across that the domain name was being used by the Respondent without authorization and hence filed suit.

Findings & Award:

Disputed domain name identical and confusingly similar;

Has no rights or legitimate interest ;

Registered in bad faith;

Ordered that the domain name be transferred to the Complainant.
