The Complainant is a Company founded on December 2, 2008 in the United Kingdom. It is the creator of world famous and popular whitebard animation software. Also, they specialize in storytelling tools like VideoScribe and StoryPix, to help businesses, charities and educators tell stories with power. They claimed to have coined the word ‘SPARKOL’ around March 2009 and have been using it since in more than 160 countries, worldwide. They have  registered the mark in India as well. The Respondent registered this domain name on December 16, 2016 and used it in an unauthorized manner, the actions which the Complainant took notice of and filed this suit.

Findings & Award:

Disputed domain name identical and confusingly similar;

Has no rights or legitimate interest;

Registered in bad faith;

Ordered that the domain name be transferred to the Complainant.
