Facts of the case:

The Complainant is a corporation organized

under the laws of Sweden and is engaged in the manufacture and trade of a wide range of transportation related products and services. The said trade name, ‘VOLVO’ was adopted in the year 1915 and was consecutively thereafter, which is registered in various countries, with India being one of them. All companies under the Complainant have been carrying on the business activities through their respective websites  volvo.com, volvobuses.com  to name a few. These sites provide sufficient details about the company.

The Respondent has been carrying on the business of a wide range of heavy duty construction and industrial machines and equipment like Excavators, Bulldozer, Loaders, Forklifts, etc. However, the complainant came to know of this and took cognizance of the same and filed suit against the Respondent for such unauthorized use.

Findings & Award:

Disputed domain name identical and confusingly similar;

Has no rights or legitimate interest;

Registered in bad faith;

Ordered that the domain name be transferred to the Complainant.
