Facts of the case:
The complainant is leading fabless semi conductor company has been contributing to the infrastructure that has bought high-speed internet and other services to homes such as TV set-up box, etc. They have used the trademark BROADCOM since 1994 and have registered the same in various countries including India and also owns various domain names incorporating the trademark. The disputed domain was registered illegally.
Findings & Award:
Disputed domain name identical and confusingly similar to trademark of complainant;
It was held that addition of a word ‘digital’ which is commonly used in a particular industry, does not serve to distinguish the Domain Name.
Respondent has no rights or legitimate interest;
Respondent registered the disputed domain name in bad faith;
It was ordered that the respondent shall transfer the disputed domain name in favor of the complainant.
