The Complainant is India’s leading health and hygiene brand with the product portfolio encompassing water purification, vacuum cleaning, air purification and home security solutions. It has a base of over 20 million customers and an Indian and global presence across 53 countries. They own the marks ‘AQUAGAURD’ and ‘EUREKA FORBES’ which are also the flagship marks for the Complainant.
It came to the notice of the Complainant that the domain name was registered in the name of the Respondent on June 21, 2014 and thus, filed suit.
Findings & Award:
Disputed domain name identical and confusingly similar;
Has no rights or legitimate interest;
Registered in bad faith;
Ordered that the domain name be transferred to the Complainant.
