Facts of the case:
The Complainant is a company incorporated, under the Australian Laws, since 1994 and are engaged in the business of electrical and automation services. They claimed that they have honestly and bondafidely coined the term ‘SAGE’ which form part of their trade, corporate and business name. They are the registered proprietor of the marks ‘SAGE’, ‘SAGE DIDACTIC’ and ‘SAGE TECH ASSIST’ and ‘SAGE AUTOMATION’ (logo). Furthermore, they are the owners of various sets of domain names right from 1998. Some domain names are gotosage.com, gotosage.in, sageautomation.com, sagedidactic.com and sageracing.com, are all registered in their name.
The Respondents were using the domain name sagegroup.co.in since its registration on June 8, 2011 and the Complainant has filed suit for the same.
Findings & Award:
Disputed domain name identical and confusingly similar;
Has no rights or legitimate interest;
Registered in bad faith;
Ordered that the domain name be transferred to the Complainant.
