Facts of the case:

The complainant is the Indian subsidiary of Emerson Electric Co., and provides date center management solutions, date center designs, management tools, etc. The complainant has registered the trademark AVOCENt in India in 2003 and in various other jurisdictions as well. The domain avocent.in was registered by them in 2008. The respondent registered the disputed domain in 2014 and uses it as a parking site wherein he offers to sell the domain at Euro 2000.

Findings & Award:

Disputed domain name identical and confusingly similar to trademark of complainant;

Respondent has no rights or legitimate interest;

Respondent registered the disputed domain name in bad faith;

It was ordered that the disputed domain name be transferred in favour of the complainant.
