Facts of the case:

The complainant is the proprietor of the registered trademark “arvixe”.  The complainant is the registrant of arvixe.com since 2003.  The Respondent registered the domain name “arvixe” in 2011 and hence the case

Findings & Award:

Disputed domain name identical and confusingly similar;

Has no rights or legitimate interest registered in bad faith;

Ordered that the domain name be transferred to the complainant;

Imposed a fine of Rs. 25000 on the respondent for hijacking, sale of hijacked domain and imposed a fine of Rs. 2000 on the complainant to have bought the domain without taking recourse to the law
